Welcome to DapperDonVintage. The following Terms and Conditions apply to all orders placed through our online shop.
By using our website and placing an order, you agree to these Terms and Conditions.
1. Offer and Conclusion of Contract
The products displayed in the online shop do not constitute a binding offer but serve as an invitation for the customer to submit a purchase offer. By completing the order process, the customer submits a binding offer to conclude a purchase contract. The contract is concluded once the seller confirms the order by email.
2. Vintage and Second-Hand Goods
Our products are used vintage items. These may show signs of wear due to age and use. Such signs of wear do not constitute a defect, provided they are stated in the respective product description or are typical for vintage items.
All significant defects are explicitly stated in the respective product description.
3. Prices and VAT
All stated prices are final prices. In accordance with § 19 UStG, no VAT is charged or shown (small business regulation).
4. Payment
The available payment methods are displayed during the checkout process. The purchase price is due immediately upon conclusion of the contract.
5. Shipping and Delivery
Delivery is made to the address provided by the customer. Delivery times are non-binding unless expressly agreed otherwise.
The risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery of the goods to the customer.
6. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details can be found in our withdrawal policy available on our website.
6a. Returns, Exchanges and Condition of Goods
In the event of withdrawal, the buyer must return the goods in a condition that only allows inspection of the nature, characteristics, and functioning of the goods. The goods must not be used beyond what is necessary for such inspection and, in particular, must not be worn, washed, altered, or damaged.
Exchanges are excluded, as the items offered are one-of-a-kind (unique pieces). Only a refund within the scope of the statutory right of withdrawal is possible.
The buyer is liable for any loss in value if this is due to handling of the goods that is not necessary to examine their nature, characteristics, and functioning.
7. Warranty
For used goods, the warranty period is one year from delivery of the goods.
The reduction of the warranty period does not apply to claims for damages arising from intent or gross negligence or in the event of injury to life, body, or health.
7a. Condition, Known Defects and Exclusion of Warranty
Signs of wear, age-related wear, and other visible or described defects shown in the product descriptions or images do not constitute defects within the meaning of the law, but are part of the agreed condition of the goods.
No warranty is provided for such obvious or explicitly described defects. Warranty claims exist only for defects that were already present at the time of transfer of risk and were neither recognizable nor described.
8. Brands and Authenticity
All mentioned brands are used solely to describe the offered original products. DapperDonVintage has no economic or legal affiliation with the respective brand manufacturers.
8a. Authenticity of Products
All items offered by DapperDonVintage are checked to the best of our knowledge and belief and are sold as original goods. Our aim is to offer only authentic products.
If, despite careful inspection, it is determined in exceptional cases that an item is not authentic, the customer is entitled to a full refund of the purchase price.
Any further liability for hidden or undetectable deviations from authenticity is excluded to the extent permitted by law, provided there is no intent or gross negligence on our part.
9. Liability
We are fully liable for damages resulting from injury to life, body, or health. For all other damages, we are liable only in cases of intent or gross negligence. Any further liability is excluded to the extent permitted by law.
10. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11. Final Provisions
Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
12. Retention of Title
The goods remain the property of DapperDonVintage until full payment has been made.
